Extension of waste management fee for some SUP packaging to producer

As of January 1, 2023, the application of the definition of the term “producer or importer” for the Waste Management Contribution Packaging will change. From this date, the producer/importer will in a number of cases be responsible for paying the Waste Management Contribution to the Packaging Waste Fund for point-of-sale and SUP (Single Use Plastics) packaging.

In the link to the PDF attachment at the bottom of this post you will find the list of Afvalfonds Verpakkingen with packaging products that are named as “point-of-sale packaging”.
When point-of-sale packaging is supplied in the Netherlands, as of January 1, 2023, all OPACKGROUP companies will charge this as a surcharge on the invoice for the packaging, if it is designated on the list of the Afvalfonds.

If the packaging is branded, then the brand name holder is responsible for paying the waste management fee. In that case, we as producers will not pass on a point-of-sale packaging surcharge.
